「PTSDは傷害」とタクシー強盗の訴因変更

　長野地検上田支部は、今年９月に小諸市内で発生したタクシー強盗事件で、被害者のタクシー乗務員が発症したPTSD（心的外傷後ストレス障害）を「傷害」に当たるとし、強盗罪で起訴した加害者を強盗致傷罪で起訴するよう、長野地裁上田支部に訴因変更を請求しました。

　同地検は１０月２１日、住所不定、無職の男性（６８）を強盗罪で起訴した。男性被告は９月１２日午後１１時ごろ、小諸市大久保の路上で乗客を装ってタクシーに乗り、男性運転手（当時５９）に刃物を突きつけ、現金約２万６千円などを奪ったとされる。
　運転手は外傷は負わなかった。しかし、睡眠障害や摂食障害、フラッシュバック現象に悩まされ、起訴後、医師に長期の治療が必要なＰＴＳＤと診断された。仕事に復帰しようと運転を試みたこともあったが、まっすぐ走ることができず、現在も休職しているという。

　強盗罪と強盗致傷の違いはどうなっているのでしょうか。

（強盗）第236条　暴行又は脅迫を用いて他人の財物を強取した者は、強盗の罪とし、５年以上の有期懲役に処する。
（強盗致死傷）第240条　強盗が、人を負傷させたときは無期又は７年以上の懲役に処し、死亡させたときは死刑又は無期懲役に処する。

強盗罪は５年以上の有期懲役、強盗致傷罪は無期又は７年以上の懲役となっています。

それにしてもタクシーの防犯設備はお粗末というか何というか・・・
防犯板は私が見た限り「東高西低」という感じで、四国はおろか関西でも防犯板を付けたタクシーは余り見かけません。
一方、その防犯板ですが運転席直後だけのが多いみたいで斜め後ろからの攻撃には役立ちそうもないですね・・・
私が以前函館で乗ったことがあるタクシーの防犯板は完全に仕切るタイプではないですが運転席のみならず運転席と助手席の間まであるものを見たことがあります。これだと斜め後ろからの攻撃にも距離が生じるのでより安全かと。でも一番いいのはやはり前席と後席を完全に隔離することしかないですね・・・
